Terms and conditions

This is a draft of the terms and conditions, intended as a starting point. It has not been legally reviewed and must not be used with real customers until a lawyer has checked it.

Article 1 - Definitions

In these terms: ByCom means the ByCom service, part of Stream Service; Customer means the individual or legal entity placing a backorder; Backorder means a request for automatic registration of a domain as soon as it becomes available; Success fee means the one-time fee owed once ByCom successfully registers a domain for the customer.

Article 2 - The service

ByCom monitors the SIDN registry (and, once available, the DNS Belgium registry for .be) for the domains specified by the customer, and attempts to automatically register them as soon as they become available. ByCom does not guarantee that a domain will actually become available or that registration will succeed.

Article 3 - Payment

Placing a backorder is free. The customer only owes the success fee once ByCom actually registers the requested domain for that customer. If a domain is never registered, or is registered for someone else, no amount is owed and no refund applies.

Article 4 - Allocation between multiple backorders

If several customers place a backorder on the same domain, the default rule is first-come, first-served based on placement date.

Article 5 - Liability

ByCom makes reasonable efforts to monitor the registry carefully, but is not liable for missing out on a domain due to circumstances outside its control, such as registry outages or registration by a third party moments before ByCom.
